RULE. Rule made returnable forthwith and heard finally considering the short issue involved.

The petitioner is working as Talathi in Tahsil Office at Gondpipri. He claims to belong to 'Nhavi Banjara' (Vimukta Jati). His caste certificate is forwarded to the Scrutiny Committee for verification. Since a show cause notice was issued by the Sub-Divisional Officer seeking production of the validity certificate to terminate his services this writ petition has been filed. The learned Assistant Government Pleader for the respondents on instructions submits that the Scrutiny Committee has issued a notice to the petitioner to appear before it on 25.01.2023 since it requires further documents from the petitioner. It is further submitted that within a period of six months from the date of submission of fresh online proposal, the claim of the petitioner would be decided.

Accordingly, the Scrutiny Committee is directed to decide the claim of the petitioner within a period of six months from the date of submission of fresh online proposal by the petitioner. Till the process of verification of the caste certificate of the petitioner is completed the services of the petitioner shall not be disturbed for want of validity certificate. The continuation of the petitioner in service is subject to outcome of the proceedings before the Scrutiny Committee.
