The applicant is seeking pre-arrest bail apprehending arrest in crime registered by the nonapplicant against him for the offences punishable under Sections 420, 464(a) and 468 read with Section 34 of the Indian Penal Code.

The accusation against the applicant is that he used a fabricated concession card for availing benefit under the scheme for physically challenged persons for travelling in the bus run by the Maharashtra State Road Transport Corporation. It is submitted that about twelve persons including the applicant are found to be using fabricated concession cards.

The non-applicant has come up with the case that the investigation is still going on and the custody of the applicant is required to unearth the names of the persons

2 aba11.16 involved in preparing the fake and fabricated concession cards.

The alleged fake card which is seized shows the name and photo of the applicant. Though the involvement in the crime is disputed by the applicant, considering the facts of the case and the stage of investigation, I am not inclined to grant pre-arrest bail. The application is rejected.
