: 11 SEPT., 2015 This Court on 25/6/2015 issued non-bailable warrant against respondent-Bhimrao Kawdu Kankalwar to procure his presence before this Court in respect of the present appeal.
In execution of the non-bailable warrant issued by this Court, the executing Authority found that respondent Bhimrao Kawdu Kankalwar is reported to be dead.
Today learned A.P.P. Shri Doifode placed on record written communication by the Police Station Officer, P.S. Mul along with the death certificate issued by Chandrapur Nagar Parishad and the statement of Sarpanch of village Village Wihirgaon to show that respondent Bhimrao Kawdu Kankalwar died on 21/3/2011. Those documents are taken on record and marked "X" for identification. In view of the statement made by the learned A.P.P. Shri Doifode on the written instructions received from the P.S.O., P. S., Mul and the documents placed on record, the appeal stands abated and is disposed of.
