By this application,the applicant-wife is seeking transfer of divorce petition bearing HMP-A No.359/2023 filed by the non-applicant/husband pending on the file of Judge, Family Court, Amravati to the Family Court, Nagpur. 3.

The contention is that the wife is totally dependent on her parents and she has a minor daughter therefore, it will be difficult to the applicant-wife to attend the proceedings before the Family Court at Amravati on each date.

Though non-applicant/husband is served and in spite of giving sufficient opportunity to appear in the matter nobody appears on his behalf. Hence, the contentions made on affidavit are remained uncontroverted.

Considering the reasons mentioned in the application and looking to the convenience of the applicant-wife, a case is made out for transfer of the petition from Family Court, Amravati to Family Court, Nagpur.

Accordingly, the application is allowed.

HMP-A No.359/2023 pending before Family Court, Amravati is hereby directed to be transferred to the Family Court, Nagpur.

The application stands disposed of.
