A cheque involved in the present matter was issued in the same transaction, as the cheque involved in the Criminal Application No.40 of 2023 (Mr. Vivek Baburao Sahare ..vs.. Sau. Nitabai Babanrao Ainchwar), decided on 24.07.2023.

In the present application, a similar challenge is made, as it was made in the Criminal Application No.40 of 2023, which culminated into rejection of the said application.

Accordingly, the present application is rejected. 4.

Two months' time is granted to the applicant/accused to deposit the remaining amount of Rs.2,48,970/- in terms of the order dated 18.04.2022 in the Court of learned Judicial Magistrate First Class, Chamorshi.
