Learned Counsel for the appellant submits that the appellant/accused died on 04.12.2019 and to that effect filed a copy of death certificate, issued by Gram Panchayat Shirajgaon Band, Panchayat Samiti Chandur Bazar, Distt. Amravati. The death certificate discloses that entry regarding death of accused has been registered on 05.12.2019 and certificate is issued on 11.12.2019. 3.

Learned Counsel also submits that the heirs of deceased appellant does not want to prosecute the appeal for some other purpose. State has no dispute about the death of appellant-accused. Since, the appellant who was convicted in Special Case No. 4 of 1989, is expired and the heirs are not interested in the matter, it requires to be disposed.

In view of that appeal is disposed of since abated. Muddemal property be disposed as ordered by the Special Court.
