The Motor Accident Claims Tribunal, Nagpur as per award dated 25/02/2019 was pleased to direct the respondents therein to pay compensation to the original claimant. The appellants are not satisfied with the award. They intend to prefer an appeal.

For the reasons stated in the application, the appellants could not prefer the appeal in time. Wife of appellant No.1 expired during intervening period. Though the respondent is served, has not appeared in spite of sufficient time. The reasons for condonation of delay are convincing. Hence, the order :

i.

Delay of 226 days caused in preferring the appeal is condoned.

ii.

Appeal be registered.

iii.

The application is allowed and disposed of accordingly.
