The learned counsel for the petitioner, on instructions, submits that the petitioner does not want to pursue this writ petition, therefore, he seeks permission to withdraw the present writ petition. He has also tendered an undertaking dated 17/01/2023, signed by the petitioner, making a statement that the petitioner will vacate the suit premises on or before 31st May 2023. 2.

The Undertaking is taken on record and marked as "X" for identification.

The learned counsel appearing for the respondent, on instructions, states that she has no objection to accept the undertaking, as the petitioner is withdrawing the present petition.

In view of no objection from other side, the Undertaking is accepted. Accordingly, the Writ Petition is disposed of. No order as to costs.
