Heard Shri Meghe, learned counsel for the petitioner, Shri Patil, learned counsel for the applicants - respondent Nos. 1 & 2 and Shri Kale, learned AGP for Respondent No. 3.

Respondent No. 1 - employer seeks vacation of interim orders on the ground that after this Court passed the same, the petitioner has been remaining absent. Shri Meghe, learned counsel is seeking time to file reply. According to him, though the petitioner reported for duty, he was not permitted to join.

It is apparent that the conduct of the petitioner is subsequent to grant of interim orders. Interim orders were then granted after considering the challenge in the petition. If there is any subsequent misconduct, the employer is free to proceed against the petitioner in accordance with law in the matter.

With said liberty to the employer - Respondent No. 1 and keeping the contention of employer open, we dispose of the application.
