The learned counsel for appellant submits that respondent no.1-original accused has expired on 11.4.2016 and accordingly files a pursis on record.

Accused was acquitted of the offence punishable under section 500 IPC. Complainant preferred present appeal against the order of the learned Additional Sessions Judge allowing the appeal and acquitting accused.

In view of the death of the sole accused, cause for preferring the appeal does not survive as appeal stands abated.

Appeal being abated stands disposed of.

No costs.
