The applicant/appellant has filed these applications for seeking condonation of delay in setting aside the abatement order against respondent No. 1 and bringing his legal heir on record. It appears that despite service of notice, none appear for the legal heirs of respondent Nos. 1A to 1C and respondent No.2.

3. Considering the reasons disclosed in the applications, both applications are allowed. Delay caused in setting aside the abatement order is condoned, and the appellant is directed to bring the legal heir of respondent No.1 on record within two weeks. After carrying out the amendment, the applicant is to serve a copy of the amended appeal memo on the respondents. Both applications are allowed and disposed of.

Learned counsel for the appellant submitted that First Appeal No. 66/2012 arises out of the same accident; therefore, he requests that this appeal be tagged with First Appeal No. 66/2012, in view of the submission, both appeals be tagged together. 5.
