We have heard learned counsel for the petitioner quite at length. Ultimately what is turned out in this case is that this petition is not maintainable at law. The reason being that the petitioner has now taken part in the tender process and after having been declared technically disqualified and ineligible, the petitioner is questioning the legality or otherwise the conditions of the tender notice. Petitioner cannot take such a U-turn. Settled law would not permit the petitioner to question the conditions of tender notice. The petition is, therefore, not maintainable and it is dismissed accordingly. No costs.
