Heard learned counsel for the petitioner Shri D.S. Lambat and learned Additional Public Prosecutor for respondent Nos.1 and 2 Mrs. N.R. Tripathi.

The parole leave is sought on account of ill-health of the wife. However, no documents are filed on record to substantiate the claim of the petitioner. In that view of the matter, at present, prayer made by the petitioner to release him on parole on account of ill-health of his wife cannot be entertained. Hence, such prayer is rejected. However, it will be open for the petitioner to file appropriate documents showing the nature of .....2/-

wp19.16 illness of the wife. If such documents along with proper application is moved before the authority by the petitioner, the same shall be considered by the authorities below in accordance with law.

With these observations, the writ petition is disposed of.

Charges of learned counsel appointed for the petitioner are fixed at Rs.1500/-.
