Learned counsel for respondent no. 1 has no objection.

Perused the record. It appears that the petition arises out of order dated 26-9-2017 passed below Exhibit 5 in R.C.A. No. 47/2011 by learned District Judge-1, Achalpur. When enquired as to what is the status of appeal, learned counsel for respondent no. 1 submits that it is listed for final argument. If that be so, there appears no reason why should present appeal be kept pending. Order dated 26-9-2017 passed below Exhibit 5 continued for all these years. Let it be, therefore, continued pending appeal.

It will be in the interest of justice, the appellate Court should decide the appeal as expeditiously as possible. The parties shall cooperate with the appellate Court for final disposal of R.C.A. No. 47/2011. The request for adjournment should be strictly dealt with by the first appellate Court. 5.

With the above observations, the appeal is disposed of.
