IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH, NAGPUR.

WRIT PETITION NO. 260 OF 2014 (Ajitpalsingh s/o Nirmalsingh Khalsa & Anr. vs. State of Maharashtra thr. its Secretary, Department of School Education & Sports & Anr.) __________________________________________________________________________ Office Notes, Office Memoranda of Coram, appearances, Court's orders or directions Court's or Judge's orders.

and Registrar's Orders.

CORAM : B.P. DHARMADHIKARI & A.P. BHANGALE, JJ.

JANUARY 15, 2015.

Heard Shri Khanzode, learned counsel for the petitioners and Smt. Joshi, learned AGP for the respondents.

The effort of the petitioners is to demonstrate that the Government Resolution dated 30.12.2013 makes arbitrary discrimination between players in employment and players who are not in employment. It is pointed out that Petitioner No. 2 is hardly 21 years old and as such had no occasion to apply earlier for grant of any employment. The petitioners claim that they have participated in Tug of War Tournament in 2012.

The learned AGP invites attention to reply affidavit. It is also pointed out that the petitioners are claiming employment with the State Government. In this situation, the petitioners have got

151wp260.14 remedy to approach the Maharashtra Administrative Tribunal under Section 19 of the Maharashtra Administrative Tribunals Act, 1985.

With liberty to the petitioners to avail that remedy, we dispose of the present writ petition. No order as to costs.
