Shri N.R. Saboo, Advocate for the appellant has submitted that the appeal is filed challenging the order passed by the learned Magistrate dismissing the complaint filed by the appellant under Section 138 of the Negotiable Instruments Act, 1881. It is further submitted that he is not having any instructions from the appellant for bringing legal representatives of deceased respondent on record.

In view of the above, the appeal stands abated. It is disposed accordingly.
