On the last date of hearing, a statement was made on behalf of the appellant that costs had been deposited and that proof of the same would be placed on record during the course of the day. The appellant was further directed to file copies of depositions and other documents for hearing of this appeal as it pertained to offence under Section 138 of the Negotiable Instruments Act, 1881.

The office note shows that the counsel for the appellant has not filed pursis regarding deposit of costs and copies of depositions have also not been filed. In these circumstances, two weeks time as last chance is granted to the appellant to place on record proof of deposit of costs and also to place on record copies of depositions, failing which this appeal shall be dismissed without further reference to the Court.
