nd January, 2015 The question involved is of the interpretation of the provisions and taking a logical view of the matter. The question is whether the person, who himself has been nominated for election from a constituency, can either propose or second the another candidate as opponent in the same constituency. The question can be dealt with by the Co-operative Court in exercise of its jurisdiction under Section 91 of the Maharashtra Co-operative Societies Act, 1960.
Hence, the petition is dismissed for availability of alternate statutory remedy for redressal of the grievances. All questions raised in this petition are open to be decided in an election petition.
