Heard Shri Ambatkar, Advocate for the applicant. Perused the report lodged by the complainant. Perusal of the report it is clear that only allegation against the present applicant is that he introduced complainant Subhash to one Sarfaraj. Thereafter, there is no role of applicant in the whole transaction. The complainant after the introduction he himself met alone with Sarfaraj and he had given amount to Sarfaraj from time to time the total amount of Rs.15 lakh was given by the complainant to Sarfaraj and not to the present applicant.

Learned APP Shri Rode has submitted that the applicant is labour and amount of Rs.13 lakh found in his account. The Court has to see the contents of the FIR/charge-sheet etc. The report itself shows that except the introduction by applicant no specific role is shown in the transaction. The report clearly shows that complainant has

ba25.19.O.odt deposited/given Rs.15 lakh from time to time to one Sarfaraj and not to the present applicant. Hence, the following order.

[i] The application is allowed.

[ii] The applicant be released on bail on furnishing P.R. bond in the sum of Rs.25,000/- with one solvent surety in like amount on the following conditions.

[a] The applicant shall cooperate in the investigation.

[b] The applicant shall not tamper the evidence of prosecution.

[c] The applicant shall attend the trial Court on each and every date.

[d] The applicant shall not leave the jurisdiction of trial Court.

[e] The breach of any condition amounts to cancellation of bail.
