The learned counsel for the applicant submits that, after rejection of bail application by this Court and on expediting the trial when it was found that there is no progress in the trial, a fresh application was moved before the trial Court.

Thereupon, the trial Court disclosed its mind to not to entertain the application on the ground that the earlier rejection of bail was by the High Court. Therefore, the application was not pressed by the applicant. 3.

In the circumstances, the applicant submits that, the applicant wants to press the application before the trial Court however, the earlier order may come in the way of the applicant before the trial Court.

In the above referred facts and circumstances, I am of the opinion that, the applicant shall be granted a chance to apply before the trial Court for grant of bail on the ground that, there is no progress in the trial and also on other grounds. Accordingly, the applicant is permitted to withdraw the present application with liberty to move afresh before the trial Court.

Criminal Application is disposed of as withdrawn.
