Shri Tembhare, the learned Additional Public Prosecutor has placed on record a communication addressed on behalf of Superintendent of Police, Wardha dated 21.12.2017 which states that the appellant-accused expired at Sewagram Hospital, Wardha on 12.12.2017.
Shri Tembhare, the learned A.P.P. however, states that it is apparent from the 174 A.D. intimation annexed to the said letter, that the appellant died on 07.12.2017.
The fact is that the appellant is dead. The appeal stands abated.
The communication dated 21.12.2017 addressed by the Superintendent of Police, Wardha to the Public Prosecutor, High Court, Nagpur and the A.D. enquiry intimation are collectively marked 'X' and taken on record. The appeal is disposed of.
