At the outset, learned counsel Shri B.H. Tekam for the applicant submits that wrongly the application under Section 439 of the Code of Criminal Procedure is filed. In fact, he wants to challenge the order passed by learned Additional Sessions Judge at Chandrapur by filing the revision. Therefore, he submits that he wishes to withdraw the present application with a liberty to file a revision challenging order passed by learned Additional Sessions Judge at Chandrapur dated 30.12.2017.
