Criminal Application (APPA) No.19 of 2017 Heard.
This application is for suspension of sentence imposed upon applicant and for bail. The applicant is found convicted for the offence punishable under Section 7 of the Prevention of Corruption Act, 1988 and sentenced to suffer simple imprisonment for .....2/-
one year and to pay a fine of Rs.5,000/-, in default, to suffer simple imprisonment for one month. The applicant is further convicted for the offence punishable under Section 13(2) read with Section 13(1)(d) of the said Act and is sentenced to suffer simple imprisonment for one year and to pay a fine of Rs.5,000/-, in default, to undergo simple imprisonment for one month. Both sentences are directed to run concurrently.
Learned counsel for the applicant has contended that applicant was on bail pending trial and has made payment of fine amount. It is also submitted that sentence is suspended by the Special Court, till the appeal period is over.
Considering the fact that applicant was on bail pending trial and that amount of fine is paid and as sentence is suspended till filing of the appeal which is preferred within limitation, the application is allowed as per order below:
ORDER
1. Substantive sentence imposed upon applicant stands suspended, pending appeal.
2. Applicant shall be released on bail on his executing P.R. Bond in the sum of .....3/-
Rs.25,000/- with one surety in the like amount.
3. While on bail, applicant shall mark his presence with Ner Police Station, District Yavatmal once in six months, pending appeal.
4. The criminal application is disposed of accordingly.
