1] The learned Advocate for the petitioner mentioned this matter out of turn which is at serial No.201 on the final hearing board dated 20.1.2020. It is submitted that the order under challenge is dated 28.6.2016 by which the Industrial Court has concluded that the petitioner is not an industry under Section 2(j) of the Industrial Disputes Act, 1947 and complaint (ULP) No.16/2014 was not maintainable.

2] It is, therefore, submitted on instructions that the petitioner desires to withdraw this petition so as to avail of a remedy as may be permissible in law. 3] Considering the above, this petition is disposed off. If the petitioner has a statutory remedy available, he may avail of the same as may be permissible in law.

4] Rule is discharged.
