The challenge raised in the present writ petition is to the order passed by the learned Joint Charity Commissioner in proceedings under Section 41-D of the Maharashtra Public Trusts Act, 1950. By that order the said application seeking removal of the respondent No.1 as Trustee has been rejected. It is informed by Shri M. V. Samarth, learned counsel for the respondent No.1 that on 22/04/2018 the respondent No.1 has expired. He placed on record pursis along with death certificate in that regard.

In that view of the matter the challenge as raised to the impugned order is rendered infructuous. The writ petition is disposed of as infructuous. Rule is discharged. No costs. JUDGE Asmita
