In this writ petition, the order below Exhibit 41 dated 2nd February, 2019 passed by the 19th Joint Civil Judge, Senior Division, Nagpur in Regular Civil Suit No.989 of 2016, allowing the application to set aside the order of no cross, is under challenge. The said order was passed on 2nd February, 2018 i.e. five years back and after filling of this writ petition dated 9th January, 2020, no steps were taken to get the matter listed before this Court. Moreover, on the last date i.e. 3rd January, 2023, none appeared on behalf of the petitioner and therefore to grant one more opportunity, it was posted for today i.e. 25th January, 2023.
