On last occasion, though specifically time was sought for and given to rebut the contention that 'B' Summary has been filed, the learned counsel for the petitioner, though initially made a statement that record has been verified, is avoiding to make any definite statement in this respect.

In view of this, we accept the statement made on affidavit by respondent No. 2 and with liberty to the petitioner to take such other steps as are open in law, we dispose of the present petition. No costs.
