14th February, 2018 By this application, the applicant prays that one of the conditions imposed while enlarging the applicant on bail be modified.

By order dated 16th November, 2017, the applicant who had been arrested in connection with Crime No. 1226/2017 registered at Ramnagar Police Station, Chandrapur, for the offences punishable under Sections 420, 467, 468 and 471 read with Section 34 of Indian Penal Code, as well as Sections 4,5,6 and 7 of the Maharashtra Prevention of Malpractices at University, Board & others Specified Examinations Act, 1982 was enlarged on bail. It was ordered that he would stay out of Chandrapur city till completion of trial. In the present application, it is stated that the applicant holds the post of Principal at the Senior College and he is unable to

resume his duties after his release. It is further stated that his daughter is taking education and he is required to arrange for her annual fees and, therefore, he is required to take steps in the city itself. It is further stated that charge-sheet has been filed and as the investigation is complete, the aforesaid condition be relaxed.

The application is opposed by the non-applicant by filing reply. It is stated that considering the gravity of the offence, the condition has been rightly imposed. Perused the application and the documents along with it.

It is not in dispute that the applicant is holding the post of a Principal at the Senior College. Other documents indicate medical treatment being taken by him. It is not likely that the trial would commence in the near future. Hence, accepting the averments made in the application, the condition imposed that the applicant would not enter the limits of Chandrapur city is relaxed. However, the applicant shall not take any steps to influence the prosecution witnesses or tamper with the material collected by the prosecution.
