The petitioners claim to be residents of Gadchandur and are aggrieved by the Resolution purportedly, passed by the Municipal Council, which is not made party herein. It is the Chief Executive Officer, who is shown as the second respondent.

The petitioners challenged the Resolution passed by the Municipal Council, whereby no objection to opening country liquor shop was granted in favour of respondents 3 and 4, before the Collector under Section 308 of the Maharashtra Municipal, Nagar Panchayat and Industrial Township Act, 1965. The Collector did not oblige and the petitioners are invoking writ and supervisory jurisdiction. 4.

I am not inclined to entertain the petition since the authority under the Maharashtra Prohibition Act, has already granted the license in favour of the respondents 3 and 4, is the statement made by the learned Counsel for the petitioner Mr. Dhawas.

The petitioners are free to appropriately object to the grant of license, or its renewal on all available grounds. The grounds raised herein, are kept open.

The petition is disposed of.
