AUGUST 16, 2017 At the outset, Mr. Khandewale, learned counsel for the applicants submits that the applicants wish to avail the alternate efficacious remedy of filing revision before the revisional Court and therefore he prays for withdrawal of the present application.

The applicants are permitted to withdraw the present application to challenge the order of issuance of process passed by learned Chief Judicial Magistrate before the revisional Court by filing the revision. If the revision is filed within four weeks from today and if the revision is accompanied with an application for condonation of delay, the said application shall be considered by learned revisional Court sympathetically keeping in mind the principles of the Limitation Act.

The interim stay granted by this Court on 17.01.2017 shall remain in operation for next six weeks from today. After six weeks, said order shall cease to exist. The application stands disposed of accordingly. JUDGE kahale
