07th July, 2017 The applicant prays that execution of the decree passed by the trial Court be stayed during pendency of the appeal. By said decree, the defendants were directed to hand over possession of the suit property to the plaintiffs.

The prayer is opposed by the learned counsel for the respondent nos. 1 and 2.

However, as the appeal has been admitted and applicant is in possession, the execution of the impugned decree shall remain stayed during pendency of the appeal. The applicant, however, shall not create

any third-party rights in the suit property.

Civil Application is disposed of.
