Heard Shri S. Raisuddin, the learned Advocate for the applicants and Ms. Anita M. Singh, the learned Advocate for the non-applicant no.3.

Though the application is opposed by the nonapplicant no.3-Insurance Company, there is no counter affidavit denying the averments made by the applicants in the application praying for condonation of delay. The nonapplicant nos. 1 and 2 have not put in appearance and there is no opposition by them. As the statements made on oath by the applicants are uncontroverted, the application is allowed. The delay is condoned.
