Heard both the learned Counsel appearing for the parties.

There is a grievance about non-compliance of the order passed by the Labour Court, Nagpur. The respondent was directed to pay the difference in between the pay as per minimum wages. On one hand, the petitioner is making grievance about noncompliance of the said order, whereas, on the other hand, the respondent has challenged this order by way of two writ petitions. These petitions are pending for admission.

On the last date, on behalf of the respondent, an objection as to the maintainability was taken. The submissions made on behalf of both the

cp30.19.odt 2/2 sides were recorded on last date i.e. on 13th September, 2019.

Today, the learned Counsel Mrs. Giratkar for the petitioner prays leave to withdraw this contempt petition as the writ petitions are pending.

Leave to withdraw this contempt petition is granted.

The petitioner can take appropriate decision after the final decision of the writ petitions. If he decides to file fresh contempt petition, the objection taken about the maintainability on the last date can be considered at that stage after hearing the parties on merit.

The petition is disposed of as withdrawn with no order as to costs.
