DATE : 06/03/2023 This is the third offence so far as the present petitioner is concerned. Para 7 of the reply at page 58 of the petition demonstrates this position. Though the vehicle number involved in the present petition is different, the person owning the vehicle is the same. This would clearly demonstrate that inspite of the earlier release of the other vehicle and execution of the bond, the petitioner has again indulged in illegal transportation of sand. This conduct of the petitioner does not entitle him to any discretion at the hands of this Court, considering which the petition is dismissed. No costs.
