The petitioner was appointed as Asha Worker on honourarium basis pursuant to the resolution passed by the Gram Sabha. Post enquiry, the contractual services of the petitioner were terminated without offering an opportunity of hearing to her.

In response to the submissions of violation of Articles 14 and 300-A of the Constitution of India, the counsel for the respondents concedes that the petitioner was not heard.

As such, the impugned order is quashed and set aside. We permit the petitioner to appear before the respondent No.3 on 12-8-2024 by treating the termination order as a show cause notice. Liberty to the petitioner to place on record all her objections in writing.

Let the petitioner be heard by the said Authority before passing any order in relation to the aforesaid services of the petitioner.
