Shri Bhide, the learned counsel for the applicants fairly states that the proceedings for obtaining mutual divorce under Section 13 (b) of the Hindu Marriage Act has been filed and are likely to be culminated into the decree in the month of June 2015.

In our opinion, it will be appropriate for the applicants to approach this Court for the relief in the subject matter of the present application only after the proceedings for divorce, as aforesaid, are culminated into the final judgment and decree of the competent Family Court. We, therefore, make the following order:- Order Criminal Application (APL)no.30/2013 is allowed to be withdrawn with liberty to file fresh application in the same subject matter after the proceedings for divorce by mutual consent are terminated and certified copies of the judgment and decree is filed along with fresh application.
