Present application seeking to grant early hearing in the aforesaid appeal on the premise that respondent No.1/original claimant has suffered serious injury in the accident resulting in 42% permanent partial disability.

By the Court's Order dated 04.01.2024, the parties were put to notice that the appeal may be taken up for final hearing at the stage of admission and liberty was granted to the parties to file Prity

2 / 2 5.caf228.2025 compilation of documents. The learned counsel for the applicant has filed the compilation of documents in compliance with the said order dated 04.01.2024. 4.

The learned counsel for the appellant fairly stated that the appellant has no statutory defence in the case.

Respondent Nos.2 & 3 have been already served. However, they have not filed their appearance.

In view thereof, and considering the disability suffered by the applicant, the appeal can be taken up for final hearing. As a result, the application is allowed.
