The challenge in this petition is to the order dated 11.11.2013 whereby the petitioner is dismissed from service with effect from 25.06.2013.

Such dismissal was based on the petitioner's act of securing employment on a certificate of Scheduled Tribe of belonging to 'Halba' caste. The fact remains that the order of invalidation has already attained finality.

The acquittal of the petitioner was reversed by the Apex Court and the matter is remanded back.

In that view of the matter, we deem it appropriate to dispose of the petition with liberty to the petitioner to approach afresh for questioning his dismissal in case if his acquittal is maintained. 6.

Needless to clarify that we have not gone into the merits of the matter.
