The petitioner is the original defendant who is aggrieved by the order passed by the Appellate Court rejecting his amendment application.

Heard learned counsel for the parties and perused the impugned order. Considering the fact that the application for amendment was moved when the appeal was to be heard finally by the Appellate Court, I am not inclined to exercise writ jurisdiction. Keeping open the rights of the petitioner herein to urge this contention in future proceedings if necessary, the writ petition is dismissed with no order as to costs.
