DATED : FEBRUARY 11, 2015 The petitioner has approached this Court being aggrieved by rejection of his application for parole.
The petitioner, who is undergoing life imprisonment for the offence punishable under Section 302 of Indian Penal Code, had applied for grant of parole on the ground of death of his brother. The brother of petitioner expired on 11/11/2013 and the petitioner applied for grant of
1102wp29.15 2/2 parole on 28/2/2014, i.e. after about three months from the date of death of his brother. Moreover, earlier when petitioner was released on parole, he did not return within the stipulated period and was absconding for 5280 days.
Having considered above aspects, we find that there is no substance in the criminal writ petition and hence, the same is dismissed.
The fee payable to the learned Counsel appointed for the petitioner is quantified as rupees fifteen hundred.
