By this application, the applicant is seeking relaxation of the condition which is imposed on the applicant while granting bail.

The condition was imposed on the applicant that he shall not enter into the vicinity of Pulgaon, District Wardha till the conclusion of the trial without prior permission from the Court.

The said application is strongly opposed by the State on the ground that the said condition is imposed, considering the apprehension raised by the prosecution regarding tampering of the witnesses. The charge is already framed against the present applicant but the witnesses are yet to be examined. The apprehension is still in existence and prays for the rejection of the application.

After considering the reply and the facts under which the said condition is imposed, no ground is made out to relax the said condition therefore, the application deserves to be rejected.

In view of that, the criminal application is rejected.
