Before filing this application, the present applicant filed an application i.e. Criminal Application (BA) No.820 of 2017. The said application was placed before me on 8.9.2017 and after hearing learned counsel for the applicant and when the Court was about to dismiss the said application, learned counsel in the said application submitted that he wishes to withdraw the said application.

Today, learned counsel U.P. Dable for the applicant submitted that no instruction was given to him about filing of the earlier bail application after filing of the charge-sheet. Therefore, that statement was not made in the application. However, after perusing the reply filed on behalf of the State, the said fact was made known to him since order dated 8.9.2017 is annexed along with the reply by learned Additional Public Prosecutor for the State. 3.

The applicant is having every right to file as many .....2/-

ba19.18 28 application for bail as he wishes. However for filing successive application it is the duty of the applicant to point out the change in circumstance. Learned counsel Shri U.P. Dable for the applicant submits that there is no change in circumstance and, therefore, he submitted that he wishes to withdraw the present application. 4.

The criminal application is dismissed as withdrawn. JUDGE !! BRW !!
