Heard.

In view of the finding recorded by the learned Sessions Judge that the sexual intercourse is consensual, the only issue to be determined is whether the prosecution has established that the victim was aged less than 18 years. Since I was not inclined to suspend the sentence and was of the view that in view of the limited issue the appeal can be finally heard, the learned counsel Shri R.M. Daga seeks leave to withdraw the application for suspension of sentence.
