Learned counsel for the Petitioner submitted that the Scrutiny Committee before invalidating the caste claim of the Petitioners has not conducted any enquiry through the vigilance cell and has directly taken aid of external agencies such as handwriting expert and C.I.D. He also submits that this course of action is contrary to the provisions of the Maharashtra Scheduled Castes, ScheduledTribes, Denotified Tribes (Vimukta Jatis), Nomadic Tribes, Other Backward Classes and Special Backward Category (Regulation of Issuance and Verification of) Caste Certificate Act, 2000 Act and the Rules framed thereunder. 3.

Issue notice to the Respondent returnable in three weeks. Learned Additional Government Pleader waives service of notice on behalf of sole Respondent. Reply to be filed before the next date.
