This application is moved seeking relaxation of the condition that the applicant shall surrender his passport before the jurisdictional court.

Several circumstances are pleaded in the application in support of the prayer seeking relaxation of condition.

It would not be necessary for this Court to look into the entitlement to return of passport, which would essentially depend on the facts pointed out to the jurisdictional court, as and when such dire situation arises. 4.
The condition is modified to the extent that the applicant is permitted to apply before the jurisdictional court and make out a case for return of the passport, for a
appp67.21.O.odt temporary period or otherwise, and if such application is moved, the same shall be considered by the jurisdictional court on its own merit.

The application is partly allowed in the aforestated terms.
