The present application is filed by applicant for transfer of proceedings filed by the non-applicant vide Marriage Petition No.564/2024 pending before the learned 7th Joint Civil Judge Senior Division, Chandrapur, under Section 9 of the Hindu Marriage Act for restitution of conjugal rights to the learned Principal Judge, Family Court, Bhandara, as there is proceedings pending for divorce filed by the present applicant.

It is submitted that she has filed Marriage Petition No.118/2024, which is filed earlier in point of time. As such, considering the convenience, the application is allowed.

The pending proceeding i.e. Marriage Petition No.564/2024 before the learned 7th Joint Civil Judge Senior Division, Chandrapur, is hereby withdrawn and transferred to learned Principal Judge, Family Court,

2 46 mca 23-2025 Bhandara, to be heard along with Marriage Petition No.118/2024.

The learned Principal Judge, Chandrapur, to expedite the transfer of file.

The application is allowed and disposed of accordingly.
