In this petition order below Exh.13 dated 16/08/2019 passed by the District Judge at Hinganghat in MANRJI No.05 of 2017 is under challenge, whereby the application Exh.13 filed by the petitioner raising objection to the maintainability of the proceedings on the ground of territorial jurisdiction, was rejected. It is evident from the record that in the meantime, the District Judge-1, Hinganghat proceeded with the matter and now it is fixed for final hearing.

The proceeding is under Section 25 of the Guardian and Wards Act and the objection to the territorial jurisdiction was raised on the ground that the minor son at the relevant time was staying at Pune. However, the learned counsel for the petitioner fairly states that presently he is staying at Hinganghat.

Thus, in the above referred facts and circumstances, as the ground on which the application Exh.13, does not survive, I do not want to interfere in the order impugned.

Accordingly, the Writ Petition is dismissed. No order as to costs.
