DATE : 16.2.2016 Heard Shri P.K. Sathianathan, advocate for the applicant and Shri T.A. Mirza, A.P.P. for the non-applicant. The applicant is arrested in the crime No.13/2015 registered by the non-applicant for the offences punishable under Sections 302, 143, 147, 148, 149, 120-B, 212, 201, 34 of the Indian Penal Code read with Section 25 of the Arms Act. According to the prosecution, the applicant knows the co-accused, the applicant was seen with the co-accused after the incident and the call details report show the presence of applicant at the house of co-accused no.4 - Purandar Yadav.

2 ba24.16 The applicant is not disputing that he is acquainted with the co-accused.

The charge-sheet is filed. The non-applicant has not been able to show that custody of applicant is required for further investigation. The non-applicant has not averred that the applicant has been involved in any crime, earlier. Considering the facts on the record, I am satisfied that the applicant has to be released on bail.

Hence, the following order:

The applicant having been arrested in Crime No.13/2015 registered by the non-applicant be released on bail on furnishing P.R. bond in the sum of Rs.25,000/- and two solvent sureties in the like amount. Out of two solvent sureties, one solvent surety shall be furnished by father of the applicant.

The applicant shall attend on every date of sessions trial unless he is granted exemption by the Sessions Court. In case of default on the part of the applicant to attend on any date of sessions trial without seeking exemption from the Sessions Court, this order shall stand recalled. The
