The petitioner has a limited grievance to canvass. 3.

The petitioner contends that respondent nos. 5 to 28 were held ineligible to be members of respondent no.4Society. 4.

It is contended that the order of the respondent no.3 - Assistant Registrar, Co-operative Societies holding the private respondents ineligible is challenged in appeal and the respondent no.1 - Divisional Joint Registrar, Co-operative Societies has granted stay and has listed the appeal for hearing on 22.02.2022. The submission is that the delay shall render the appeal infructuous and the remedy illusory. Mr. P.S. Patil would submit that a direction be issued to the respondent no.1 to decide the appeal within 7 days. 5.

The submission is reasonable. In view of the limited nature of the relief sought, it would not be necessary to issue notice to the private respondents.

Respondent no.1 - Divisional Joint Registrar, Cooperative Societies shall decide the Appeal No.8 of 2022 within 7 days from the date of appearance of the parties. 7.

The petitioner shall appear before the Appellate Authority, after serving an advance notice of such appearance, which notice shall be accompanied by copy of this order, to the learned Counsel for the private respondents who appears in the proceedings pending before the Appellate authority, on 01.02.2022.

The Writ Petition is disposed of in the aforesaid terms.
