It would not be necessary to issue notice to the respondent on this civil application as none had appeared on behalf of the respondent when the writ petition was dismissed for want of prosecution.
For the reasons stated in the application, the delay in filing the restoration application is condoned. The civil application is allowed and disposed of. M.C.A. ST. NO.770/2017.
It would not be necessary to issue notice to the respondent on this miscellaneous civil application as none had appeared on behalf of the respondent when the writ petition was dismissed for want of prosecution. For the reasons stated in the miscellaneous civil application, the writ petition is restored to file subject to payment of costs of Rupees Five Hundred to the High Court Bar Association, Nagpur within one week.
